Such taxes are, by law, the responsibility of IYS to collect.
  • If any provision of these Terms of Use or the Privacy Policy is deemed illegal, void, or unenforceable for any reason, the remaining provisions will not be affected and will remain valid and enforceable to the fullest extent possible.
  • The Terms of Use and Privacy Policy constitute the entire agreement regarding the conditions of use of the Platform. The Contracting Party declares to be aware of the rights and obligations arising from these Terms of Use and Privacy Policy, having read, understood and accepted all the terms and conditions.
  • Any failure by IYS to enforce or exercise any provision of these Terms of Use, the Privacy Policy, or related rights, does not constitute a waiver of such right or provision.
  • Discount coupons can be used in the corresponding field on our website, always limited to one discount coupon per purchase and per person, and cannot be combined with other offers and/or promotions in effect at the time.
  • The coupon offer will not be valid until it is applied to the qualifying item and/or the minimum purchase amount is reached.
  • If you return any of the items purchased with a coupon, the discount or coupon value may be deducted from your return credit.

9. Validity, modifications and termination

These Terms of Use and Privacy Policy will be valid indefinitely from the date of acceptance and may be unilaterally terminated by IYS at any time, without any charge, by simply communicating through the Platform itself or by sending a message to the email address registered by the User.

IYS may, at any time, change these Terms of Use or the Privacy Policy at its sole discretion. Any changes to these Terms of Use and the Privacy Policy will be communicated through the Platform. If you continue to use the services provided by IYS after receiving notification indicating that the Terms of Use have been changed, we will consider that you agree to the changes.

The date of the last update made by IYS to these Terms of Use will always be indicated. You understand and agree that, as soon as the change to these Terms of Use/Privacy Policy is published on the Platform, its use will be subject to the updated Terms of Use/Privacy Policy.

10. Limitation of Liability

IYS will not be liable under any circumstances, even jointly or severally:

  • Due to situations of unforeseen circumstances or force majeure, as defined in article 393 of the Brazilian Civil Code, including, without limitation, temporary failures or unavailability of its system;
  • The authenticity, validity, and accuracy of the registration data provided by Users are your responsibility to verify, on your own, whether such information is true and complete before registering on the Platform;
  • For the services or Products offered on the Platform by third parties, including with regard to their availability, quality, quantity, essential characteristics, offers, prices, payment methods or any other elements relating to them;
  • For damages caused by programs harmful to the Platform, such as, but not limited to, viruses, Trojans, and hackers;

We make no guarantee that the Platform will meet your needs, that its operation will be uninterrupted or error-free, that any functionality or Content will remain available, that any defects in the Platform will be corrected, or that the Platform will be compatible with or function with any third-party software, applications, or services.

11. Applicable Law and Jurisdiction

These Terms of Use shall be interpreted exclusively in accordance with the laws of Brazil. The parties elect the Court of the District of São Paulo, State of São Paulo, as the sole competent court to settle any dispute arising from these Terms of Use or the Privacy Policy.
